First “Thank You” for yet another great year! We continue to be aggressive in new product development and have grown double digits again this year. Your business and support is very much appreciated.

 

Please find attached our new Jobber Price Sheet effective May 1, 2019. Please take a moment to review.

Also attached for your review are the 2019 Terms and Conditions. We have made a few minor changes to our existing programs that are listed below.

2019 Terms and Conditions

 

Payment Terms:

Payment Terms are to be CC or wire transfer. Orders must be paid in full prior to shipment. Net terms can be negotiated only after 1 year of business with 0 payment issues.

 

 

 

 

Early Pay:

None

 

 

 

Deductions:

Forced deductions are not allowed for any reason. Unauthorized credits may cause the account to be placed on hold. Contact your sales representative regarding any disputes.

Prepaid Freight:

Expedited Shipments:

Varies depending on discount level. Please see your salesman for details.

Requests for expedited shipments must be made in writing and will be the responsibility of the account unless specifically approved in writing by Pro Eagle senior management.

 

Drop Shipments:

Available in the U.S. only.

 

Fee - Drop Ship:

$10.00 fee will be added to all floor jacks and Co2 jacks, a 2% fee will be added for all jack accessories.

 

Fee - Minimum Order:

New account Minimum Opening orders Quantity will be 5 jacks of any size or style.

 

Shortages/Errors:

Any shipping shortages or shipping damage should be noted on the freight bill and be reported to Pro Eagle in writing within 24 hours of receipt.

 

Pricing:

Pricing is subject to change without notice. If an order is sent without pricing, you are accepting the prices on Pro Eagle’s order confirmation.

 

Price Levels:

Pro Eagle has multiple pricing levels, which are indicated on our Jobber Sheet

 

Warranty:

Returns for claimed defects or warranty must be sent freight prepaid with Pro Eagle’s RGA number. Credit will be issued at Pro Eagle’s discretion after a thorough inspection. Parts returned as defective that are found to be without fault will be subject to restocking fees.

 

Stock Adjustments:

Annual stock adjustments are limited to 2% of previous year net purchases, with a 2:1 offsetting order. You must request an RGA, and send all items freight prepaid. Products must be current (on current Pro Eagle price sheet) and in original packaging. Credit will be issued at Pro Eagle’s discretion upon inspection. All products must be in resalable condition. Any stock return above the annual stock adjustment allowance will be subject to a 15% restocking fee.

Cancellations:

 

Will call is available at our location.

Any Shipment made to any address other than the Distribution Center or Centers we have on record of each account will be considered a “drop shipment”.

Any order that is cancelled after the order is entered and acknowledgement sent but before the tracking number is issued will be charged $10.00 Cancellation Fee.   Any order cancelled after the tracking number is issued will be subject to a restocking fee of $25.

 

Returned Shipments:

Shipments returned by the carrier or refused by the recipient will be subject to a rejected shipment fee of $25.00.

 

Changes:

Pro Eagle reserves the right to change parts, products, pricing, and programs at any time without notice.

 

Order Fulfillment:

All orders are subject to stock availability. Drop ship orders received by 1:00PM PST will be entered and shipped same day provided stock is available. Pro Eagle Customer Service will notify you if an item cannot be shipped. Stocking orders are typically shipped within 7 business days.

 

 

 

         2019 MAP (Minimum Advertised Price) Policy

 

Policy Details

  • Pro Eagle minimum advertised retail price will be no lower than current jobber price. This policy applies to all types of consumer advertising and does not apply to wholesale advertising in any way.

 

  • This policy is for advertised retail price and does not apply to selling price. As a Pro Eagle reseller, you have the right to sell Pro Eagle products at whatever price is deemed necessary. Advertised price is defined as any and all publicly displayed retail prices. The below listed advertising tactics are considered retail advertising and must be in compliance in accordance to this MAP policy at all times.

 

    • Print/Radio/TV/Online advertising.
    • Website/Ecommerce Pages.
    • Google/Yahoo/MSN shopping internet searches and feeds.
    • eBay/Amazon online stores
    • Print catalogs/fliers/newsletters.
    • “In the Cart Pricing”

 

  • Pro Eagle considers “in the cart” pricing as advertising. Pro Eagle will allow “ in the cart” discounting of up to 5% off of current jobber in the cart for various promotional codes, specials, sales, etc. Any “in the cart” pricing that is found to be lower than 5% below current jobber will be a violation.

 

Violations:

Please report violations through email to chuck@austinmfginc.com. Violations will be dealt with the highest importance:

  1. Customer will be notified of the violation and will be given 24 hours to correct.
  2. If there is no correction, then the customer goes on the Pro Eagle “Do Not Sell” list indefinitely, until Pro Eagle decides to remove the customer.
  3. All Pro Eagle wholesale distributors are not allowed to sell to customers on the “Do Not Sell” list until notified. Any Pro Eagle wholesale distributor found selling to resellers on the “Do Not Sell” list run the risk of having discounts removed or your Pro Eagle account being closed.
  4. If corrections are not made, use of Pro Eagle intellectual property (logos, images, etc.) will be withdrawn.
  5. If a direct account, your account may be closed.

 

Exceptions:

This policy does not apply to: Any Pro Eagle product under $50 jobber price, apparel, promotional items, discontinued products, or private label products. This policy is subject to change without notice, and may not be modified, waived, or amended by anyone other than the president or GM of Pro Eagle.

Product Warranty Policy

 

General Terms:

  • Pro Eagle warrants their products to be free from manufacturer’s defects due to workmanship and material.
  • This warranty applies only to the original purchaser of the product and is non-transferrable.
  • Proof of purchase of the Pro Eagle product is required for all warranty claims.
  • Warranty is valid provided Pro Eagle instructions for use and/or cleaning were properly followed.
  • Proper maintenance with regular inspections of product is required to insure warranty coverage.
  • Damage due to improper use, abuse, unauthorized repair or alteration is not warranted.
  • Incidental or consequential damages or cost, including installation and removal of part, incurred due to failure of Pro Eagle product is not covered under this warranty.
  • All warranty is limited to the repair and/or replacement of the Pro Eagle part. To request Return Goods Authorization ("RGA"), mareily@austinmfginc.com or call 310-513-8694. Upon receipt of the RGA, you must return the product to the address provided in the RGA, freight prepaid and accompanied with a dated proof of purchase and the RGA. Upon receipt of the defective product and upon verification of proof of purchase, Pro Eagle will either repair or replace the defective product within a reasonable time, not to exceed thirty days.

No other warranty expressed or implied applies nor is any person or Pro Eagle authorized to assume any other warranty. Some States do not allow the exclusion or limitation of incidental or consequential damages or do not allow limitations on how long an implied warranty lasts, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from State to State.
